Walls ORDINANCE NO. 9584 AN ORDINANCE CLOSING AND ABANDONING A PORTION OF LEE AVENUE AND AN ALLEY LOCATED SOUTHEAST FROM O'GRADY DRIVE, NORTHEAST OF ELDER MOUNTAIN ROAD, MORE PARTICULARLY DESCRIBED HEREIN, UPON CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby closed and abandoned a portion of Lee Avenue and an alley located southeast from O'Grady Drive, northeast of Elder Mountain Road, more particularly described herein, and as shown on plat attached hereto and made a part hereof by reference: Lee Avenue, a 40 foot wide unopened right-of-way beginning on the southeast line of O'Grady Drive 990 feet northeast of the intersection of the southeast line of O'Grady Drive with the northeast line of Elder Mountain Road, said point being the northwest corner of block 15, West Chattanooga Land Company's Subdivision No. 1, as shown by plat of record in plat book 6, page 34, R.O.H.C., thence northeast 40 feet with O'Grady Drive to the southwest line of block 16, said subdivision, thence southeast 250 feet with the southwest line of said block 16 to the southeast corner of lot 5, block 16, thence southwest 40 feet to the northeast corner of lot 16, block 15, thence northwest 250 feet with the northeast line of block 15 to the southeast line of O'Grady Drive, the point of beginning. Said street separates lots 16-20, block 15, from lots 1-5, block 16, said West Chattanooga Land Company Subdivision. 0C A 20 foot wide unopened alleyway beginning on the southeast line of O'Grady Drive 1170 feet northeast of the intersection of the southeast line of O'Grady Drive with the northeast line of Elder Mountain Road, said point being the northwest corner of lot 1, block 16, said West Chattanooga Land Company's Subdivision No. 1, thence northeast 20 feet with O'Grady Drive to the southwest corner of lot 20, block 16, thence southeast 250 feet with the southwest line of lots 20, 19, 18, 17, and 16, to the southeast corner of lot 16, thence southwest 20 feet to the northeast corner of lot 5, block 16, thence northwest 250 feet with the northeast line of lots 5, 4, 3, 2, and 1, to the southeast line of O'Grady Drive, the point of beginning. Said alleyway separates lots 1-5, block 16, from lots 16-20, block 16, said subdivision. Tax Map. No. 144C-E-1, 2, and 3. SECTION 2. BE IT FURTHER ORDAINED, That this closure and abandonment is made subject to the following conditions: 1. The City of Chattanooga has a sewer located within the right-of-way of Lee Avenue and reserves an easement the width of said right-of-way for the purpose of maintaining said sewer. 2. The areas reserved for utility easements must be kept free and clear of all structures. 3. All existing easements are retained. SECTION 3.
